Terms of Service

Spaugur's terms of service for use of our services. What you can expect from us and what we expect from you.

The overview below is a simplification provided for explanation. The terms of service themselves are what apply.

Cancel before the 28th

Cancellation must be received before the 28th day of the month and takes effect on the first day of the following month.

14 days to process

The standard processing time for service requests does not exceed 14 days from when the request is received.

Compensation for service outages

Compensation amounts to 5% of the monthly fee for each day a service disruption lasts.

Changes announced in advance

Changes to the terms of service are announced on the website at least one month in advance.

General terms

Apply to all services provided by Spaugur unless special provisions state otherwise.

    Scope and changes

    The following terms apply to all services provided by Spaugur ehf. unless special provisions in specific terms or agreements state otherwise. Anyone requesting service undertakes to comply with the terms and conditions Spaugur sets for use of the service. Spaugur reserves the right to make changes to its terms and services. Changes are announced on the company's website at least one month before they take effect.

    Access to premises

    A telecommunications connection is normally not established at a property unless the owner permits, free of charge, the installation of equipment in the building or on the land. The person requesting service must ensure that such permission is in place.

  3. 03

    Identifiers and additional features

    Upon signing a service agreement, the customer is assigned an identifier, unless the matter concerns the transfer of a previously assigned identifier. The customer must specifically request additional features such as number privacy, blocks, or custom settings.

    Processing time for service requests

    The standard processing time for service requests does not exceed 14 days from when the request is received, unless circumstances beyond Spaugur's control prevent this.

    Assignment of the agreement

    If a customer wishes to assign their service agreement to a third party, this must be applied for in writing. Spaugur will approve such an assignment provided nothing prevents it and all fees for the service have been paid up to the date of assignment. Spaugur may assign its own rights and obligations under the agreement to a third party capable of providing comparable service.

    Service interruptions and liability

    Spaugur is not liable for temporary service interruptions but will seek to restore service as quickly as possible. If repairs are delayed unreasonably, the customer may demand a refund proportional to the time the service was interrupted. Spaugur is not liable for damage resulting from loss of connection or other disruptions, whether caused by equipment failure, connection issues, or other causes.

    Equipment owned by Spaugur

    Customers must take good care of all equipment owned by Spaugur that is provided to them. If equipment is damaged or lost through intent or negligence, the customer is liable for compensation. If equipment is not returned, or is unfit for further rental upon return, its value may be charged to the customer.

  8. 08

    Misuse and disruptions

    If a customer's use causes significant disruption to the service or constitutes misuse, Spaugur may restrict or terminate the service, temporarily or permanently. The same applies if incorrect information is provided that affects the agreement between the parties.

  9. 09

    Conduct toward staff

    Spaugur reserves the right to terminate service if a customer behaves in a threatening or abusive manner toward staff. Employees are permitted to refuse to attend a site if the circumstances could have a negative effect on their health.

  10. 10

    Continued billing during suspension

    If service is suspended due to the customer's fault, the obligation to pay continues until the agreement is terminated by either party.

  11. 11

    Unlimited service used for commercial purposes

    It is not permitted to use an unlimited service plan for commercial purposes without written consent. A breach of this entitles Spaugur to terminate the agreement and charge for the service used according to the standard price list.

  12. 12

    Use within the EEA

    Customers subscribing to data transfer or telecommunications services may use the allowance included under the terms of their subscription within the European Economic Area, as specified in the price list. Excess use is charged according to the current price list.

  13. 13

    Data processing and offers

    Spaugur reserves the right to process customer data for the purpose of offering new subscription plans, services, or special offers. Spaugur may also make contact for commercial purposes regardless of registration in the phone directory. The customer may decline such communication.

  14. 14

    Termination of service

    Termination of service must be submitted in writing or by email to spaugur@spaugur.is before the 28th day of the month. Termination takes effect on the first day of the following month.

  15. 15

    Recording of calls

    Spaugur reserves the right to record calls to customer service to ensure quality and to log their content. Recordings are only accessible to relevant staff or to authorities as required by law.

  16. 16

    Orders and offers

    When ordering a service, accurate information must be provided. An order or acceptance of an offer is binding on both parties.

  17. 17

    Compensation for service interruptions

    Customers are entitled to compensation for service interruptions or delays amounting to 5% of the monthly fee for each day the disruption lasts. Applications for compensation must be sent to spaugur@spaugur.is and will be answered within three weeks. If an application is rejected, the decision may be appealed to the relevant supervisory authority.

Termination

How a service agreement is terminated and what applies regarding minimum commitment periods.

  1. 01

    Notice period

    Either party may terminate a service agreement, except where special provisions apply, and the termination must be in writing. Notice must be received before the 28th day of each month and takes effect at the start of the next billing period, on the 1st day of each month.

  2. 02

    Changes to the terms

    Individual subscribers are entitled to terminate their service agreement without paying damages when they receive notice of a planned change to the terms of service.

  3. 03

    Setup costs

    Setup costs that may arise at the start of an individual service are generally waived provided the customer maintains their service agreement for six months. Spaugur reserves the right to charge the customer for the setup cost if the customer cancels or switches to a different type of connection within six months of the start of service.

  4. 04

    Return of rented equipment

    See Article 7 of the general terms regarding the return of rented equipment.

  5. 05

    Binding agreements

    Spaugur may offer agreements under which the customer commits for up to six months. If the customer terminates such an agreement during its term, Spaugur reserves the right to charge the customer for the unpaid monthly fees remaining in the term, plus a termination fee pursuant to Article 14 of the general terms.
